Sport Generation Terms and Conditions

1. General Provisions

1.1. These Terms and Conditions govern the use of the website https://sport-generation.com/ (hereinafter referred to as the “Website”) and define the rights and obligations of users and the Sport Generation administration (hereinafter referred to as the “Administration”) arising from the operation of the Website or the use of its services.

1.2. These Terms and Conditions constitute a public offer under applicable law, and the User’s acceptance by the User consists in using the Site in any form, including viewing materials, placing an order, creating a personal account, sending inquiries, or other actions—means that the User agrees to these Terms and Conditions. In case of disagreement with individual provisions, the User must immediately cease using the Site.

1.3. The subject matter of these Terms and Conditions is the legal relationship arising in connection with the purchase and sale of goods by the User.

1.4. The purchase and sale agreement shall be deemed concluded upon the placement of an order, which consists of the User clicking the “Buy,” “Buy in 1 Click,” or other action technically provided by the Administration.

1.5. The Administration reserves the right to modify, update, or supplement these Terms and Conditions at any time without prior notice. The current version is always posted on the Website and takes effect upon publication.

1.6. If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

1.7. The Administration ensures the operation of the Site but does not guarantee its uninterrupted operation due to technical failures, force majeure, the operation of third-party services, or network restrictions.

1.8. All materials posted on the Site (texts, photos, graphic elements, logos, product descriptions, instructions, structural blocks) are the intellectual property of Sport Generation and are protected by copyright law. It is prohibited to copy, distribute, or use the Site’s content without permission from the Administration.

2. Terms and Definitions 

In these Terms and Conditions, the following terms have the meanings set forth below:

2.1. Website – the Sport Generation website located at https://sport-generation.com/, including all pages, materials, graphic or structural elements, and services.

2.2. Administration/Seller – the Sport Generation administration, which ensures the operation of the Website, accepts and processes orders, provides consultation and support, and performs other functions related to serving Users.

2.3. User/Buyer – any legally competent natural person, legal entity, or individual entrepreneur who visits the Website, views materials, places an Order, or performs other actions involving the use of the Website’s services.

2.4. Order — a request submitted by the User to purchase Product(s) through the Website, confirmed by clicking the “Buy,” “Buy in 1 Click,” “Place Order” button, or by performing another action indicating the intent to make a purchase.

2.5. Product — goods presented on the Website and available for purchase, including sports nutrition, vitamins, supplements, and accessories, information about which is posted by the Administration.

2.6. Account – a registered User profile on the Website containing personal data, order history, settings, and other information necessary for interacting with the Website.

2.7. Agreement—an agreement between the Buyer and the Administration, which is deemed concluded upon the Buyer’s acceptance of the Order and remains in effect until the receipt of the Goods and/or full/partial payment.

2.8. Delivery — a service for transferring the Goods to the User, carried out by third-party logistics services in accordance with the selected delivery method and the carrier’s terms and conditions.

2.9. Carrier—an independent logistics or courier service that transports and delivers the Order to the User in accordance with its internal rules and rates.

2.10. Payment—the process by which the User pays for the Goods using the method specified on the Website.

2.11. Expiration Date — the date or period during which the Product retains its properties and can be safely used in accordance with the manufacturer’s requirements. Information regarding the expiration date is indicated on the packaging or in the Product description.

2.12. Personal Data — information about the User provided during registration, placing an Order, or interacting with the Website and processed in accordance with Sport Generation’s Privacy Policy.

2.13. Website Content—all text, graphics, photos, and video materials, as well as other elements posted by the Administration, which are subject to copyright and may not be used without the Administration’s permission.

2.14. Force Majeure — events beyond the control of the Parties (natural disasters, technical failures, acts of war, communication disruptions, decisions by government authorities, etc.) that make it impossible to properly fulfill these Terms and Conditions.

3. Terms of Use

3.1. The User may use the Website solely in accordance with its intended purpose: viewing products, obtaining advice and placing Orders, creating an Account, and leaving reviews.

3.2. Registration may be required for certain features of the Website. The User guarantees that the personal data provided is complete, accurate, and up-to-date; specifically, the following data must be provided for registration:

3.2.1. First and last name;

3.2.2. Phone number;

3.2.3. Email address;

3.2.4. Password.

3.3. Any interference with the operation of the Site is prohibited, including attempts at unauthorized access, the use of bots or scripts, copying of content, server overload, or other actions that may harm the operation of the Site.

3.4. Users are prohibited from posting comments or materials on the Site that are offensive, illegal, false, or promotional in nature. The Administration may remove such materials without notifying the user.

3.5. Product information on the Site is for reference purposes only. In the event of inaccuracies, the Administration reserves the right to modify the information without prior notice until the Order is placed.

3.6. The Site’s content is the property of Sport Generation and is protected by applicable law. Copying or using the materials without written permission is prohibited.

3.7. The Administration has the right to restrict the User’s access to the Website in the event of a violation of these Terms and Conditions.

3.8. The operation of the Website may be temporarily restricted due to technical work, malfunctions, or force majeure circumstances.

3.9. Changes to the rules take effect upon their publication by the Administration on the Site.

4. Buyer’s Rights and Obligations

4.1. The Buyer has the right to

4.1.1. Review products, their specifications, and terms of purchase;

4.1.2. Use the communication tools available on the Site;

4.1.3. Receive support in the form of consultation or resolution of disputes from the Administration;

4.1.4. Request a replacement or return of goods in accordance with the rules and the law;

4.1.5. Create an Account and use its additional features.

4.2. The Buyer is required to

4.2.1. Refrain from any unauthorized actions regarding the Website, including copying content and interfering with technical processes;

4.2.2. Ensure the confidentiality of Account data;

4.2.3. Provide accurate personal information for delivery and payment;

4.2.4. Pay for the goods in a timely manner;

4.2.5. Inspect the goods upon receipt and report any defects within the timeframes specified by law and the Return Policy;

4.2.6. Review changes to the Terms and Conditions.

5. Rights and Responsibilities of the Seller/Administration

5.1. The seller has the right to

5.1.1. Change the product range, prices, and product specifications without prior notice to the User;

5.1.2. Refuse to fulfill an order if the Buyer violates these Terms and Conditions;

5.1.3. Temporarily suspend the Website’s operation for maintenance;

5.1.4. Cancel an order if the product is out of stock after notifying the Buyer;

5.1.5. Contact the Buyer to clarify order details.

5.2. The Seller is obligated to

5.2.1. Ensure that Orders can be placed through the Website;

5.2.2. Provide accurate information about products to the extent available to the Administration;

5.2.3. Process data about Buyers in accordance with the Privacy Policy;

5.2.4. Deliver the goods in accordance with the confirmed order;

5.2.5. Comply with the delivery terms and return policy;

5.2.6. Address User inquiries in accordance with the established procedure.

6. Ordering Process

6.1. Orders are placed using the online shopping cart on the Website. Adding an item to the cart does not constitute a reservation.

6.2. To place an Order, the User must complete a form containing personal information, a shipping address, and a payment method.

6.3. After the form is submitted, the Website generates a preliminary Order confirmation. Final confirmation is provided by the Administration or an automated system.

6.4. The Administration has the right to request additional information from the User that is necessary to fulfill the Order.

6.5. In the event of a technical error, price change, or product unavailability, the Administration will notify the User for further coordination.

6.6. If the Buyer does not respond within 24 hours, the Seller may cancel the Order.

7. Payment for goods

7.1. The Buyer may choose one of the payment methods available on the Website:

7.1.1. Online payment via Visa/Mastercard to the specified IBAN;

7.1.2. Cash on delivery.

7.2. When paying online, all information is processed by secure payment services. The administration does not store and does not have access to the Buyer’s payment data.

7.3. In the case of cash on delivery, the Buyer is obligated to make full payment before receiving the Order from the carrier.

7.4. The price of the product listed on the Website at the time of placing the Order is final, except in cases of technical errors or outdated information.

7.5. The Seller reserves the right to require prepayment for certain categories of products or orders with specific characteristics.

8. Delivery

8.1. Goods are delivered throughout Ukraine via a Carrier listed on the Website at the time of placing an Order.

8.2. The Buyer independently selects the delivery method and address and is responsible for the accuracy of the information provided.

8.3. Delivery times depend on the selected Carrier, region, and product availability in stock.

8.4. The cost of delivery is determined by the Carrier’s rates and is paid by the Buyer, unless otherwise specified on the Website.

8.5. Upon transfer of the Order to the Carrier, the risks of damage, loss, or delay of the goods pass to the Carrier.

8.6. The Buyer must inspect the package upon receipt. In the event of damage or shortage, the Buyer is obligated to draw up a report with the Carrier’s representative.

9. Return Policy

9.1. Returns are permitted in accordance with the Law of Ukraine “On Consumer Protection” upon the Buyer’s submission of a corresponding request within 14 calendar days.

9.2. Returns are permitted for items not included in the list set forth in Resolution No. 172 of the Cabinet of Ministers of Ukraine dated March 19, 1994.

9.3. To create a return request, you must follow the terms and instructions set forth in the Return Policy and submit your request to the contact email address support@sport-generation.com.

10. Confidentiality of Information

10.1. The Buyer’s personal data is collected, stored, and processed by the Seller in accordance with applicable laws and Sport Generation’s internal Privacy Policy.

10.2. The information is used for:

10.2.1. Fulfilling orders;

10.2.2. Communicating with the Buyer;

10.2.3. Providing technical support;

10.2.4. Improving the functionality of the Website;

10.2.5. Marketing and analytical purposes (with the Buyer’s consent).

10.3. Access to personal data is limited to authorized personnel of the Administration and third parties engaged in delivery, payment processing, or Website maintenance.

10.4. The Seller does not disclose information to third parties without legal grounds or without the Buyer’s consent, except as required by government authorities within the scope of the law.

10.5. Use of the Website constitutes the Buyer’s consent to the processing of their personal data in accordance with Sport Generation’s Privacy Policy.

10.6. The Buyer has the right to request the deletion, correction, or clarification of their personal data at any time by contacting info@sport-generation.com.

11. Information notices

11.1. The Administration reserves the right to send the User email and SMS messages containing information about the status of orders, the operation of the Website, changes to the Terms, and other important system notifications.

11.2. Marketing communications (promotions, offers, news) are sent only with the User’s consent, which is automatically granted upon use of the Site. You may opt out at any time by writing to info@sport-generation.com.

11.3. Opting out of marketing messages does not affect the receipt of service and technical notifications necessary for order fulfillment.

12. Liability of the Parties and Dispute Resolution

12.1. Each party has the rights and assumes the responsibilities set forth in Sections 4 and 5 of these Terms and Conditions.

12.2. In the event of a dispute regarding the fulfillment of an Order, the quality of goods, or the use of the Website, the User must submit a written complaint to support@sport-generation.com.

12.3. The Administration will review the complaint within 5–10 business days and provide an official response explaining its position or proposing a solution.

12.4. If the parties fail to reach an agreement through negotiations or a written settlement, the dispute shall be referred to the courts of Ukraine for consideration in accordance with applicable law.

12.5. The parties agree that pre-trial dispute resolution is a mandatory step and helps reduce time and financial costs while facilitating the rapid achievement of a mutual resolution.

13. Rules for the Use of Materials Posted on the Site

13.1. All materials posted on the Site (text, photos, videos, logos, product descriptions, page layout) are the intellectual property of Sport Generation.

13.2. Any copying, publication, reproduction, or distribution of materials without the Administration’s permission is prohibited.

13.3. The User may use the information on the Website solely for informational purposes.

13.4. Any unauthorized use of the materials constitutes a copyright infringement and may result in legal liability.

14. Term of the Agreement

14.1. The Agreement is deemed to have been concluded upon the User’s acceptance of its terms, as evidenced by the User’s use of the Website or the placement of an Order.

14.2. The Agreement remains in effect until the parties have fully fulfilled their obligations or until the User ceases to use the Website.

14.3. Certain provisions related to the processing of personal data, intellectual property, and the liability of the parties remain in effect even after the termination of the Agreement.

15. Additional Terms and Conditions

15.1. Any matters not covered by these Terms and Conditions, the Privacy Policy, the Return Policy, or other guidelines described on the Website shall be governed by the applicable laws of Ukraine.

15.2. The Administration may introduce temporary promotions, special offers, or discounts, which will be subject to separate terms and conditions.

15.3. The invalidity of any individual provision of these Terms and Conditions shall not affect the validity of the remaining provisions.
